							<p><em><strong>        </strong></em>In TURKEY; <strong>“The philosophy of secularism”</strong> people who are under the influence of the ideology and lose their personality traits <strong>“Identity Crisis” </strong>is in the foreground. This identity crisis is caused by the Turkish citizens <strong>"State"</strong> It is possible to see it more clearly in the understanding. When we say state, a widespread bureaucracy, a strict hierarchy and a political regime based on a strong army come to mind. However, there are some differences between the state and the political regime.</p>
<p>Today, the state has become an institution that interferes with everything from the way individuals dress to their thoughts, from their beliefs to their worship, and even from their loves to their hates. There is no madness that it cannot do to show itself powerful. The French Revolution <strong> nationalism, l</strong><strong>“secularism and democracy”   </strong>The Russian revolution <strong> “power of the working class” </strong>The modern theories he initiated and developed in his name (despite all his claims) have made people's lives miserable. <strong>“Unity of Education”  </strong>brainwashing with the understanding, <strong>"Civil law" </strong>The state mentality that pokes its nose into everything by imposing its will (no matter how much the contrary is claimed) has a totalitarian structure. After all, people <strong>“Slave of the State” </strong>There is no way to defend this practice, which makes it into a state of unrest. But strangely enough, most people (including some Muslim intellectuals) <strong>"Totalitarian" </strong>They continue to defend the regimes. Even <strong>“The Islamic State;” </strong>There are even those who say that the regime does not take into account people's right to vote and be elected (their consent), but rather unconditional obedience, and that there can be no factions (sects) in that regime.   <strong>This is the conclusion reached by those who claim to base themselves on the Quran and the Sunnah, but reject ijma and ijtihad. Of course, this is a false understanding.</strong>.</p>
<p>in recent years <strong>“My constitution</strong><strong>"Iz Quran" </strong>They keep chanting the slogan in the name of Islam <strong>'A totalitarian political regime' </strong>groups have also emerged that aim to establish. However, the Holy Quran is the word of Allah (Kalamullah) and will last until the Day of Judgment. It is definitely not a constitutional text. Constitutional law consists of a contract between the political authority and the subjects, based on the determination of duties, responsibilities and rights. It is also known that the Messenger of Allah (pbuh) prepared a contract in Medina after the migration. If <strong>“My constitution</strong><strong>"Iz Quran" </strong>If the slogan is used to reject the Sunnah, Ijma' and Ijtihad, this is a greater disaster because it leads people to disbelief. If <strong>“Our Constitution is the Quran”</strong> If our other laws are used in the form of Sunnah, ijma and qiyas-i jurists, this would be a mistake.</p>
<p>The fundamental goal of Islam is to ensure the safety of people’s lives, property, offspring, minds and religion, and to protect their rights and freedoms. The state is merely a means of achieving these. It is by no means a sacred entity. Furthermore, the reason for the state’s existence is to meet the common needs of people and to serve humanity. The essential thing is humans. Because humans are the caliphs of Allah Almighty (cc) on earth. According to Islam, the state must be based on law (the sharia) and take people’s consent as its basis. These two principles (law and people’s consent) are indispensable pillars. Because being based on law (the sharia) is essential for being a means for people’s happiness both in this world and the hereafter, and being based on people’s consent is essential for the continuity of power.</p>
<p>According to Islam, the state must be based on the consent of the people; proof for believers   <strong>“Pledge of Allegiance”</strong> for non-muslims  <strong>“The contract of embezzlement”</strong> is an obligation. Both the allegiance and the dhimma contract are ways of expressing consent. Its form may change according to time and place. However, its content and essence do not change. <sup> </sup></p>
<p>After this introduction; bringing the consent of the believers to the agenda <strong>“Pledge of Allegiance”</strong> Let's focus on the concept.</p>
<p>It is necessary for people who are the caliphs of Allah Almighty (cc) on earth to give back the trust to its rightful owner and to uphold justice. If they show weakness in this regard, they will be subject to many calamities and disasters. The Arabic word Bay'at <strong>“To accept, to consent and to confirm”</strong> It means things like shopping. <strong>“To the Bey”</strong> It is also from the same root. In a sense, this is a political transaction. It is an act completed with an offer and acceptance. In Islamic terminology, Bay'at: <strong>“It is the promise of a responsible person to obey and remain loyal to the caliph (Imam, Ulu'l-emr) appointed by a competent community (Ahl al-Aqd).”</strong> In a sense, this is an oath of loyalty that the taxpayer takes to obey every Islamic (legitimate) command, whether he likes it or not.</p>
<p>Because the Messenger of Allah (pbuh) said: “<strong>Muslims obey those in authority over them in all matters, whether they like it or not. They are obliged to do so. However, if they are ordered to commit sins, they do not obey.</strong>It is known that he said: “In another hadith:<strong>There is no obedience to the known in a place or matter where there is rebellion against Allah Almighty (cc). Obedience is only in the known.</strong>“(2) It has been stated. Therefore, the obedience that emerges as a result of the allegiance is limited to Islamic rules. Allegiance is necessary for the proper implementation of the rules revealed by Allah Almighty (swt) and for regulating the relations between people. Islamic scholars   <strong>“Pledge of Allegiance” </strong>  Every man and woman who is responsible for the knowledge related to  <strong>“it is fard-i ayn”</strong> They are unanimous on this issue. In fact, Ibn Humam said: <strong>“The reason why believers need to choose an imam from among themselves is to fulfill Islamic orders properly.” </strong>(3) He points out the sensitivity of the issue.</p>
<p>In order for the Imam to be obeyed, he must be truthful, knowledgeable, brave and resolute enough to be obeyed, he must be free, he must not discriminate among those who have sworn allegiance to him, and he must believe that if any harm comes to any of them, it comes to the whole society and poses a threat to the society, he must be capable of understanding all kinds of tricks and methods of the enemy, and he must conduct his affairs through consultation, staying away from taghut methods.</p>
<p>The pledge of allegiance is a righteous deed that is proven by the Book, the Sunnah and the consensus of the Companions. In the Holy Quran, it is stated in the address to the Messenger of Allah (pbuh):  <strong>“Those who swear allegiance to you, swear allegiance only to Allah. The hand of Allah is over their hands. So whoever breaks (this covenant, this bond of allegiance), breaks it against his own good. And whoever fulfills what he has covenanted with Allah, Allah will give him a great reward.”</strong>(4) The ruling has been declared. Allegiance is a contract that shows sincerity in people's relations with each other and with political authority that they are willing to obey the rulings of Islam. As it is known, it has been made obligatory for believers to obey a political authority chosen from among themselves with definite texts. In fact, it is stated in the Holy Quran: <strong>“O you who believe! Obey Allah, obey the Messenger and you</strong><strong>And obey those in authority (the Ulu'l-emr) from among them..</strong>(5) The commandment has been given. Determining the person who is capable of achieving the basic goals of Islam and overcoming all kinds of obstacles in this cause is an important issue. For this reason, the jurists have been meticulous about the qualities sought in the person to whom the allegiance will be made.</p>
<p>It is certain that the caliph (ulû'l-emr) can emerge as a result of the declaration of will and consent of the believers. The allegiance taken by force and by force of the sword (with coercion) is not valid. Some of the scholars  <strong>“Necessity”</strong> They mentioned that in the event of a situation, one can obey those who come to power through tyranny (using force) but apply Islamic rules. In fact, Ibn Abidin  <strong>“Red-du'l Mukhtar”</strong>in:<strong> The tyrant's sultanate is valid due to necessity</strong>” he says. However, he must have the qualities that the Imam must have. The main thing in appointing the caliphate is the election of the believers. The contract of the Imamate is either by the caliph choosing someone in his place - as Hazrat Abu Bakr (ra) did, or by the allegiance of a congregation of scholars and people of knowledge. According to Imam Ashari, the allegiance of a famous scholar from among the people of knowledge is sufficient, provided that it is in the presence of witnesses. The fact that it is in the presence of witnesses is to repel him if there is denial.</p>
<p>The Mu'tazila, on the other hand, stipulated the allegiance of five people, while some of the Hanafis stipulated the allegiance of a congregation, and did not consider a certain number. The purpose of necessity is to prevent discord. The Messenger of Allah (pbuh) also said:<strong>You are an Abyssinian with a cut nose  </strong> <strong>Even if a slave becomes a ruler, listen and obey!..(6) he said.</strong>He explains the nature of the issue by saying, “The far-sighted Islamic scholars, <strong>“necessity”</strong> He knows that the boundaries of his concept are quite delicate. The caliphate of tyrants, sinners, madmen and children; <strong>“Let there be no discord”</strong> The Ummah has paid a heavy price for agreeing on the grounds that it is obligatory for the formation of taghuti powers in Islamic lands. <strong>“don’t give the trust to the rightful owner”</strong> The abandonment of the verb has a large share.</p>
<p>The Messenger of Allah (pbuh) said:  <strong>"When the matter falls into the hands of an unqualified person, beware of the apocalypse"</strong> (7) The determination in the meaning should be well thought out. Moreover, it is not enough for the commander of the believers (Caliph) to be pious. It is necessary for this pious Caliph to give duties to the most qualified believers in every field. As a matter of fact, in a Hadith: <strong>“Anyone who assigns a duty to someone else, even though he has a more qualified Muslim to rule over, has truly betrayed Allah, His Messenger, and the Islamic Ummah.”</strong> (8) The ruling has been declared. The knowledge related to the allegiance is obligatory upon every believing man and woman.</p>
<p>The Caliph's relations with non-Muslims   <strong>“Debit Contract”</strong> <strong>It is imperative that they do so and protect their rights.</strong></p>
<p><strong>                   </strong> <strong>COMMUNITY IS NOT A STATE</strong></p>
<p>Today <strong>"In order for allegiance to be obligatory for a person, there must be an Islamic government (state)"</strong> There are some approaches that put forward the thesis. However, the first allegiance made by the Messenger of Allah (pbuh) and the believers took place in Aqaba. This news at the level of tawatur is available in all authentic sources. There is no one who claims the opposite. It is also known that this allegiance coincided with the end of the Meccan preaching period. Regarding the Meccan Period, Imam Sarakhsi: <strong>“At that time, Mecca was a city of polytheism where the rules of Islam were not applied.”</strong> (9) In a hadith narrated by Ibn Abbas (ra), it is stated that Medina was also in the same period. <strong>“the abode of shirk”</strong> It is recorded that it has this feature. (10)   <strong>Therefore, at the time when the first allegiance took place, there was no Islamic state.</strong>   Under those conditions, the fact that the Messenger of Allah (pbuh) took the oath of allegiance shows the necessity for the believers to choose a leader from among themselves in any case. As a matter of fact, it is stated in a hadith: <strong>"- It is not permissible for three people to live in a remote mansion in the world without appointing one of them as their ruler."</strong>(11) has been stated. Of course, this is also a political mandate. In this act, there is an effort to implement the commands and prohibitions of Islam. Abandoning this is a crime in itself. Muslims must be sensitive about this issue.</p>
<p><strong>     </strong><strong>           THE NATURE OF DYING IN IGNORANCE</strong></p>
<p>Bringing the consent of the people to the agenda, both in terms of the State and the community <strong>“Pledge of Allegiance”</strong> The act is being exploited by some circles. The establishment of the Caliphate, all <strong>Islam</strong><strong>a.m.</strong> It is obligatory upon his nation. The Messenger of Allah (pbuh) said: <strong>"- Whoever deviates from obedience to the Caliph by a span of his hand will meet Allah Almighty on the Day of Judgement without any evidence in his favor regarding his deeds. Whoever dies without pledging allegiance to the Caliph will die a death of ignorance."</strong>(12) It is known that he said. Again, Imam Ahmed b.Hanbel said: <strong>“Al-Musnad”</strong> In his work titled “- <strong>"Anyone who dies without swearing allegiance to the Imam of his time dies the death of ignorance." </strong>The hadith (as a hadith) was included. The hadith commentators; <strong>"It describes the situation of a person who does not swear allegiance with the intention of not implementing the rules of Islam, even though there is a Caliph."</strong> they stood on it.  <strong>In the absence of the Caliph, it is not possible to act according to these hadiths.   </strong>Moreover, the existence of hadiths allocating the caliphate to the Quraysh is also known.</p>
<p>In recent years, many groups fighting for Islam have: “- <strong>"Anyone who does not swear allegiance to our imam will die the death of ignorance." </strong> brings up the thesis. Whichever one you swear allegiance to, in the eyes of the other <strong>“You die the death of ignorance” </strong>It is inevitable. Some religious order sheikhs have also fallen into this trend. This is clear cruelty. Even some circles that have established an imaginary state: "- <strong>Our Imam</strong><strong>"There is no marriage for anyone who does not swear allegiance to us" </strong>They can say things like that. However, a believing man can marry a woman from the People of the Book. This is permissible according to the Sharia. Allegiance is never requested from a woman from the People of the Book. She can only be from the people of the dhimma.</p>
<p>He who thinks the state is everything and is busy with the state day and night   <strong>"totalitarian"</strong> logic makes itself felt in many areas. However, the state is not everything, it is only a means, it cannot claim to regulate every point of human life. According to Islam, the state <strong> “To meet the common needs of people and serve humanity” </strong>It is an organization established for. Its difference from other organizations <strong>“Use of Force”</strong> The community is an organization established only to meet the needs of Muslims. It has no relationship (in terms of guardianship and power of attorney) with non-Muslims. Because the Islamic community has no relationship with non-Muslims. <strong>“Debit Contract”   </strong> it is not possible to do it.</p>
<p>In conclusion, we can say that: Modern state theories and the political authority that Islam brings to the agenda are different from each other. Mixing them and bringing the totalitarian political regime concepts to the forefront is an attack against Islam.</p>
