WHAT DID ISLAMIC SCHOLARS SAY ABOUT THOSE WHO DO NOT PRAY?
Imam Abu Hanifa According to (rh), a person who abandons prayer is imprisoned until he prays. He is beaten until he bleeds. He remains imprisoned until he repents and prays. (Reddul-Mukhtar Footnote)

Imam Safi (rh) and Imam Malik According to (rh), whoever abandons a prayer or misses it out of necessity is called to repentance. If he insists on abandoning prayer, he is killed as a punishment of hadd. (Umdetu'I-Kari 24/81)

Ibn Hazm (rh) says: “Concerning the abandonment of prayer, many narrations have come to us from Umar ibn al-Khattab (ra), Mu’adh ibn Jabal (ra), Abdurrahman ibn al-Awf (ra), Abu Hurayrah (ra) and many other companions, that the one who abandons prayer is a disbeliever and an apostate. Nothing has been heard that contradicts the consensus of the companions on this matter.” (Muhalla)

Imam Ahmed ibn HanbalAccording to him, the one who abandons prayer is an unbeliever and an apostate. If he has any property, it goes to the treasury of the Islamic state. He is killed and after he is killed, he is not buried in the cemeteries belonging to Muslims. There is no difference between abandoning prayer because of denial or because of laziness.
Ahmed Ibn Hanbal (rh) also said: “Anyone who abandons prayer is an unbeliever and an apostate. He is asked to repent. If he does not repent, he is killed. He is not washed, his funeral prayer is not performed and he is not buried in a Muslim cemetery.”

Imam Ahmed Ibn Hanbal (rh) on Mansuru'l-Faqih from Shafi'is and Ibn-i Habib from Malikis They have the same opinion.

Shaykh al-Islam Ibn Taymiyyah (rh) also says, “If a person who has reached the age of puberty abandons one of the obligatory prayers or abandons one of the parts of the prayer that is definitely obligatory, he is made to repent; if he does not repent, he is killed.” (Wasiyyatu'l-Kubra 320)

It was narrated from Ibn Abbas Radiallahu Anhu that he said:

"Whoever abandons prayer has become a disbeliever." It was narrated from Ibn Mas'ud (May Allah be pleased with him) that he said:

"Whoever abandons prayer has no religion." It was narrated from Jabir ibn Abdullah (may Allah be pleased with him) that he said:

"Anyone who does not pray is an unbeliever."

It has been authentically narrated from the Prophet (peace and blessings of Allaah be upon him) that: Whoever abandons prayer is a disbeliever. Similarly, the opinion of the people of knowledge from the Prophet (peace and blessings of Allaah be upon him) is that: Whoever abandons prayer deliberately without excuse until its time has passed is a disbeliever because he has attempted to attack the abandonment of the command of Allaah Almighty. It has been narrated from the Prophet (peace and blessings of Allaah be upon him) that he said:

"Between a man and a disbeliever is abandoning prayer."

An-Nawawi said: As for abandoning prayer, if he denies its obligation, then he is a disbeliever according to the consensus of the Muslims and has left the Islamic community. However, if he has recently embraced Islam, this is not the case. If he believes that it is obligatory but abandons it because of laziness, then most of the people are in a state of indolence, and the scholars have differed on this.

    ACCORDING TO MALIKI AND SHAFī:

They said: He is not declared a disbeliever. On the contrary, he is said to be a sinner. And he is asked to repent. If he repents, that's fine. But if he doesn't repent, we will kill him as punishment. Just like a man who commits adultery, but he is killed with the sword.

ACCORDING TO MUZENI, THE FRIEND OF THE HANAFIS AND SHAFÎI:

They said that he will not be called a disbeliever, nor will he be killed. On the contrary, he will be glorified and imprisoned until he prays. This is because of the following statement of the Prophet (peace and blessings of Allah be upon him):

"The blood of a Muslim is not permissible except for one of three things." There is no abandonment of prayer in this. He is a disobedient believer."

      ACCORDING TO THE HANBALI:

It has been narrated from Abdullah ibn al-Mubarak, Ishaq ibn Rahuyah and some of the Shafi'i Companions and Imam Ali Karremallahu Weche that: He who abandons prayer intentionally and without excuse becomes a disbeliever. Upon his killing, they sought the following statement of Allah:

"If they repent, establish prayer and pay zakat, then release them." And the following statement of the Messenger of Allah (ﷺ)

I have been commanded to fight the people until they say that there is no god but Allah and they establish prayer and pay zakat. If they do that, their blood and their property will be protected from me.

The following statement of the Messenger of Allah (ﷺ) is:

"Between the servant and the disbeliever is the abandonment of prayer." They interpreted it as meaning that the disbeliever deserves the punishment for abandoning prayer, which is murder. Or it is imposed on the one who considers abandoning it lawful. And it is interpreted as disbelief and his action is the action of the disbelievers. Allahu ta'ala. His ruling after his death is the ruling of the Muslim who abandons prayer: He will not be gassed, he will not be shrouded, prayer will not be performed on him and he will not be buried in the graveyard of the Muslims. His grave will be destroyed as a betrayal to him. His wife will be divorced. We seek refuge in Allahu ta'ala.

(1) The scholars of the Companions and Tabi'een differed about the major sins. From four to seven, nine to eleven and above. Abdullah ibn Mas'ud (May Allah be pleased with him) said: They are four. Abdullah ibn 'Umar (May Allah be pleased with him) said: They are seven. Abdullah ibn 'Amr ibn al-'As (May Allah be pleased with him) said: They are nine. When Abdullah ibn 'Abbas was informed that Ibn 'Umar said: "The major sins are seven," he said: It is closer to seventy than seven. He said at once: Whatever Allah the Almighty has forbidden him is among the major sins. He and the Companions besides him said: Whatever Allah the Almighty has promised with Hell (the Fire) is among the major sins.

One of the Salaf said: Everything that is within the limits in the world is a major sin. Minor sins are those that have no limits in their sight, and those that are not threatened with fire. This was narrated from Abu Hurayrah and others.

Abdurrazzak Radiyallahu Anhu used to say: The major sins are eleven. This is the most numerous of those whose numbers can be stated concisely in one sentence. It has been said that they are vague. The truth of their number is not known. Like the vagueness of the Night of Power, the time of Friday, and the prayer of Wusta, so that people may be in fear and hope and not be certain of anything and not remain silent about anything.

Ibn Mas'ud (May Allah be pleased with him) said a beautiful word about them through istinbat. He was asked about the major sins and he said: Read thirty verses from the beginning of Surah An-Nisa until the following statement of Allah Almighty:

"If you abstain from the major sins from which you are forbidden, We will make atonement for your sins." Therefore, all the things that Allah has forbidden from the beginning of the Surah until this are among the major sins. In terms of deduction, the statement of Ibn Abbas regarding the istinbat that the Night of Power is the twenty-seventh night is similar to this. He counted the words of the Surah of Power until he reached the word "hiya", it became twenty-seven words. Allah knows the truth of these two statements."
