							<p>                 JAHILIYYA - ALLEGIANCE<br />

<p> In Turkey; the “Identity Crisis” is at the forefront among people who are under the influence of the “secular philosophy” and who have lost their personality traits. It is possible to see this identity crisis more clearly in the understanding of the “State” of the citizens of the Republic of Turkey. When we say state; a widespread bureaucracy, a strict hierarchy and a political regime based on a strong army come to mind. However, there are some differences between the state and the political regime.</p>
<p> Today, the state has become an institution that intervenes in everything from individuals' clothing to their thoughts, from their beliefs to their worship, and even from their loves to their hates. There is no crazy thing it cannot do to show itself strong. The modern theories that the French Revolution initiated and developed in the name of "nationalism, secularism and democracy" and the Russian Revolution initiated and developed in the name of "the power of the working class" (despite all their claims) have made people's lives miserable. The state understanding that washes brains with the understanding of "Tevhid-i Tedrisat" and meddles in everything with the imposition of "Civil Law" (no matter how much the contrary is claimed) has a totalitarian structure. As a result, there is no defensible aspect to this practice that turns people into "servants of the state". However, strangely enough, most people (including some Muslim intellectuals) continue to defend "Totalitarian" regimes. In fact, the "Islamic State"; There are even those who say that it does not take into account people's right to vote and be elected (their consent), but that it takes unconditional obedience as its basis and that there can be no factions (sects) in that regime. This is the conclusion reached by those who claim to base themselves on the Quran and the Sunnah and reject ijma' and ijtihad. Of course, this is a false understanding.</p>
<p>  In recent years, groups have emerged that constantly chant the slogan “Our Constitution is the Quran” and aim to establish a “totalitarian political regime” in the name of Islam. However, the Quran is the word of Allah Almighty (swt) (Kalamullah) and will endure until the Day of Judgment. It is definitely not a constitutional text. Constitutional law consists of a contract between the political authority and the subjects, based on the determination of duties, responsibilities and rights. It is also known that the Messenger of Allah (pbuh) prepared a contract in Medina after the migration. If the slogan “Our Constitution is the Quran” is used to reject the Sunnah, ijma and ijtihad, this is an even greater disaster. Because it leads people to infidelity. If “Our Constitution is the Quran” and our other laws are also based on the Sunnah, ijma and If it is used in the form of qiyas al-fuqaha, this would be an error.</p>
<p>  The fundamental goal of Islam is to ensure the safety of people’s lives, property, offspring, minds and religion, and to protect their rights and freedoms. The state is merely a means of achieving these. It is by no means a sacred entity. Furthermore, the reason for the state’s existence is to meet the common needs of people and to serve humanity. The essential thing is humans. Because humans are the caliphs of Allah Almighty (cc) on earth. According to Islam, the state must be based on law (the sharia) and take people’s consent as its basis. These two principles (law and people’s consent) are indispensable pillars. Because being based on law (the sharia) is essential for being a means for people’s happiness both in this world and the hereafter, and being based on people’s consent is essential for the continuity of power.</p>
<p>  According to Islam, the proof that the state must be based on the consent of the people is that the "Bay'ah" is an obligation for believers and the "Zimmet contract" is an obligation for non-Muslims. Both the Bay'ah and the zimmet contract are ways of expressing consent. Its form may change according to time and place. However, its content and essence do not change.  </p>
<p>  After this introduction, let's focus on the concept of "Bay'ah", which brings the consent of the believers to the agenda.</p>
<p> It is necessary for people who are the caliphs of Allah Almighty (cc) on earth to give back the trust to its rightful owner and to uphold justice. If they show weakness in this regard, they will be subject to many calamities and disasters. The Arabic word Bay'at means "to accept, to be pleased and to confirm". The word "Bay'a", meaning trade, also comes from the same root. In a sense, this is a political trade. It is an act completed with an offer and acceptance. In Islamic terminology, Bay'at is: "A person who is responsible promises to obey and remain loyal to the caliph (Imam, Ulu'l-emr) determined by a competent community (Ahl al-Aqd)." In a sense, this is an oath of loyalty that the taxpayer takes to obey every Islamic (legitimate) command, whether he likes it or not. </p>
<p>  Because it is known that the Messenger of Allah (pbuh) said: “Muslims obey those in authority over them in all matters, whether they like it or not. They are obliged to do so. However, if they are ordered to commit sins, they do not obey.” In another hadith, it is stated: “There is no obedience to the known in a place or matter where there is rebellion against Allah (swt). Obedience is only in the known.” (2) Therefore, the obedience that emerges as a result of the allegiance is limited to Islamic rules. Allegiance is necessary for the proper implementation of the rules revealed by Allah (swt) and for the regulation of relations between people. Islamic scholars agree that the sciences related to the “Allegiance” are “obligatory” on every man and woman who is responsible. In fact, Ibn Humam points out the sensitivity of the issue by saying, "The reason why believers need to choose an imam from among themselves is to fulfill Islamic orders properly." (3)</p>
<p> In order for the Imam to be obeyed, he must be truthful, knowledgeable, brave and resolute enough to be obeyed, he must be free, he must not discriminate among those who have sworn allegiance to him, and he must believe that if any harm comes to any of them, it comes to the whole society and poses a threat to the society, he must be capable of understanding all kinds of tricks and methods of the enemy, and he must conduct his affairs through consultation, staying away from taghut methods.</p>
<p> The pledge of allegiance is a righteous deed that is proven by the Book, the Sunnah and the consensus of the Companions. In the Holy Quran, it is stated in the following verse, addressing the Messenger of Allah (pbuh): “Those who pledge allegiance to you pledge allegiance only to Allah. The hand of Allah is over their hands. So whoever breaks (this pledge of allegiance), breaks it against himself. And whoever fulfills what he has covenanted with Allah, Allah will give him a great reward.” (4) The pledge is a contract that shows sincerity in people’s acceptance of the rules of Islam in their relations with each other and in their relations with political authorities. As it is known, it is made obligatory for the believers to obey a political authority (Ulu'l-emr) chosen from among themselves with definite texts. In fact, the command is given in the Holy Quran: "O you who believe!.. Obey Allah, obey the Messenger and obey those in authority (Ulu'l-emr) among you..."(5). Determining a person who can realize the basic goals of Islam and overcome all obstacles to this end is an important event. For this reason, the jurists have been meticulous about the qualities sought in a person who will pledge allegiance.<br />
 It is certain that the caliph (ulû'l-emr) can emerge as a result of the declaration of will and consent of the believers. The allegiance taken by force and by force of the sword (with coercion) is not valid. Some scholars have mentioned that in case of “necessity”, it is possible to obey those who come to power by force (using force) but apply Islamic rules. As a matter of fact, Ibn Abidin says in “Red-du'l Mukhtar”: The sultanate of a tyrant is valid due to necessity.” However, the qualities that the Imam should have must be present in him. The main thing in the appointment to the caliphate is the election of the believers. The contract of the Imamate is either by the caliph choosing someone in his place - as Hazrat Abu Bakr (ra) did, or by the allegiance of a congregation from the scholars and the people of speech. According to Imam Ashari, the allegiance of a famous scholar from the people of speech is sufficient, provided that it is in the presence of witnesses. If he denies the fact that he is in the presence of witnesses, if it happens, it is to repel it.<br />
 The Mu'tazila, on the other hand, stipulated the allegiance of five people, while some Hanafis stipulated the allegiance of a congregation, and did not consider a certain number. The purpose of necessity is to prevent discord. The Messenger of Allah (pbuh) also explained the nature of the issue by saying, "Even if an Abyssinian slave with his nose cut off becomes your ruler, listen and obey! (6)". Islamic scholars who can foresee the future know that the boundaries of the concept of "necessity" are quite delicate. The ummah has paid a heavy price for accepting the caliphate of tyrants, sinners, madmen and children on the grounds of "not causing discord". The abandonment of the obligatory act of "returning the trust to its rightful owner" has a major role in the formation of taghuti powers in Islamic lands.<br />
   The Messenger of Allah (pbuh)’s statement, “If the matter falls into the hands of an unqualified person, then wait for the Day of Judgment” (7) should be well thought over. Moreover, it is not enough for the leader of the believers (the Caliph) to be pious. It is necessary for this pious Caliph to assign duties to the most qualified of the believers in every field. As a matter of fact, it is stated in a Hadith: “Whoever assigns a duty to another Muslim, while there is someone more qualified than him, has indeed betrayed Allah, His Messenger and the Islamic Ummah.” (8) The sciences related to the allegiance are obligatory upon every believing man and woman.<br />
 It is essential for the Caliph to make a "Dhimmah Contract" with non-Muslims and protect their rights.</p>
<p>  COMMUNITY IS NOT A STATE<br />
 There are some views today that put forward the thesis that “in order for allegiance to be obligatory for a person, the existence of an Islamic government (state) is a must.” However, the first allegiance made by the Messenger of Allah (pbuh) and the believers took place in Aqaba. This report at the level of tawatur is available in all authentic sources. No one who claims otherwise can be said to exist. It is also known that this allegiance coincided with the end of the Meccan period of preaching. Regarding the Meccan period, Imam Sarakhsi puts forward the determination that “Mecca was a house of shirk in that period where the rules of Islam were not implemented.” (9) In a hadith narrated by Ibn Abbas (ra), it is recorded that Medina also had the characteristics of a “house of shirk” in the same period. (10) Therefore, there was no Islamic state at the time when the first allegiance took place. Under those conditions, the fact that the Messenger of Allah (pbuh) took the oath of allegiance shows that the believers must choose a leader from among themselves in every situation. Indeed, it is stated in a hadith: "- It is not permissible for three people to live in a remote mansion in the world without appointing one of them as their leader." (11) Of course, this is also a political mandate. In this act, there is an effort to implement the orders and prohibitions of Islam. Abandoning this is a crime in itself. Muslims must be sensitive about this issue.</p>
<p>   THE NATURE OF DYING IN IGNORANCE<br />
The act of “Pledge”, which brings the consent of the people to the agenda both in terms of the state and the community, is being exploited by some circles. The establishment of the Caliphate is obligatory upon the entire Islamic nation. It is known that the Messenger of Allah (pbuh) said: “- Whoever deviates from obedience to the Caliph by a span of his hand will meet Allah Almighty (swt) on the Day of Judgment without any evidence in his favor regarding his deeds. Whoever dies without swearing allegiance to the Caliph will die a death of ignorance.”(12) Again, the hadith (as a hadith-i vahid) of Imam Ahmad b. Hanbal in his work “Al-Musnad”, “- Whoever dies without swearing allegiance to the Imam of the time will die a death of ignorance.” The commentators of the hadith; They emphasized that this news "describes the situation of someone who does not swear allegiance with the intention of not implementing the rules of Islam, even though there is a Caliph." It is not possible to act according to these hadiths when there is no Caliph. Moreover, the existence of hadiths that assign the caliphate to the Quraysh is also known.</p>
<p> In recent years, many groups fighting for Islam have brought up the thesis: "- Anyone who does not swear allegiance to our imam will die a pre-Islamic death." No matter which one you swear allegiance to, in the eyes of the other, it is inevitable that you will "die a pre-Islamic death." Some religious leaders have also fallen for this trend. This is clear oppression. Some circles that establish imaginary states even say things like: "- Anyone who does not swear allegiance to our imam is not eligible for marriage." However, a believing man can marry a woman from the People of the Book. This is permissible according to the Sharia. Allegiance is never requested from a woman from the People of the Book. She can only be a person of dhimmah.<br />
 The “totalitarian” mentality that assumes the state is everything and is busy with the state day and night makes itself felt in many areas. However, the state is not everything, it is only a means, it cannot claim to regulate every aspect of human life. According to Islam, the state is an organization established to “meet the common needs of people and serve humanity.” Its difference from other organizations is that it has the privilege of “using force.” The community, on the other hand, is an organization established only to meet the needs of Muslims. It has no relationship with non-Muslims (in terms of guardianship and power of attorney). Because it is not possible for the Islamic community to make a “Zimmet Contract” with non-Muslims.</p>
<p> In conclusion, we can say that: Modern state theories and the political authority that Islam brings to the agenda are different from each other. Mixing them and bringing the totalitarian political regime concepts to the forefront is an attack against Islam.</p>
