And who can be better at ruling than Allah for a people who have certainty?" (Surat Al-Maidah, Verse: 50)<br /> "Let's first focus on the word. It is an Arabic word and is called mufredi jahili(1). In the dictionary, it means "ignorance, it is the opposite of knowledge. It also includes brainlessness and stupidity. It generally includes the life before the dominance of Islam."2 As a terminology, it means "not accepting the rules and information sent down by Allah (swt) and believing in the rules, ideas and systems put in place by people."<br /> It is generally used in this sense in the Holy Quran. Indeed, it is stated: “Do they still desire the ruling of the pre-Islamic period? Who can be better in ruling than Allah (swt) for those who have a righteous opinion?”3<br /> If you pay attention, this verse explains two rulings and their nature. People will submit either to the rulings of the pre-Islamic period or to the rulings of Allah (swt). It is impossible to speak of any ruling beyond these two rulings. All systems that fail to consider the boundaries of "halal" and "haram" must be based on "ignorant capital." All educational systems that fail to educate people according to the religion of Allah (swt) are also in a state of "ignorant education."<br /> A hadith narrated by Jabir ibn Zayd in the Sunan Nasa'i, "Tafsir al-Hijra", sheds light on our issue. We know that Ibn Abbas (ra) explained that Medina was a place of polytheism before the Hijra and that he pledged the allegiance of Aqaba. (4)<br /> If we take into consideration the statement of Imam Sarakhsi, while explaining the situation of Mecca before the migration, “Mecca was a city where the rules of Islam were not applied.”(5), it becomes easier for us to understand that the opposite of ignorance is Islam.<br /> The concept of ignorance is a concept that includes all kinds of beliefs and practical elements that are not based on truth and reality.<br /> Now, let's focus on the laws of the pre-Islamic period. Why don't we just say "the justice and legal system of the pre-Islamic period"? The subtlety here is this: The words "justice" and "law" are Islamic terminology.<br /> Justice is acting in accordance with the commands of Allah (swt). A Muslim who abides by this is called a just person, and a Muslim who does not abides by it is called a sinner.<br /> Law is the plural form of the word right and its literal meaning is the opposite of wrong.<br /> The concept of law is not an Islamic term. The laws of the pre-Islamic period were merely rules derived from false sharia.<br /> During the Age of Ignorance, there was no legal system based on written text among the Arabs who lived either as nomads or as civilized people.<br /> During this period, various laws were in effect throughout the Arabian Peninsula. In the Yemen region, laws were limited to the decrees of the rulers (6). In the north, around Syria and Palestine, Roman law was applied (7). In the eastern and northeastern regions, Sassanid law, influenced by the Zoroastrian religion, existed. On the other hand, Christians in this region based their human relations on church customs and traditions mixed with Roman law. As for the Hejaz region, Jews in this region acted according to the provisions of the Torah and its commentary on the Talmud, while Arabs who were in conflict with them adhered to Jewish law (8). Unwritten and unstructured, the laws of the pre-Islamic period were based on customs and traditions inherited from their ancestors (9). Indeed, the legal sanctions of the Meccan city-state were not written down.<br /> Abu Ja'fari al-Tahāwī pointed out a subtlety by saying, "If an inheritance was distributed in accordance with Islamic rules in the pre-Islamic period, or if a person who committed theft was punished in the same way in accordance with Islamic principles, these cannot be included in Islamic rules, even if they are the same in nature. Because their legislative sources are different." (18) Therefore, we cannot consider the laws enacted by the assemblies formed according to the principle that "sovereignty belongs unconditionally to the nation" as an Islamic rule. The concept of ignorance must be evaluated within this context." (Y.
