"TEXT
“If a person makes a will that food should be given to the people for three days after his death, his will is invalid. This is stated in Haniya on the authority of Abu Bakr al-Balkhi. Again, it is stated in Haniya on the authority of Abu Ja'far: 'If he makes a will that food should be given to those who offer condolences after his death,' this will is permissible in the amount of one-third of his property. This food is permissible for those who stay for a long time to offer condolences and for those who come from a long distance. However, it is not permissible for those who do not stay for a long time and do not come from a long distance. If there is any food left over, it is looked at; if there is a lot, it is compensated; if not, it is not.

I say that: The author attributed the first view to the meal that the women mourners gathered and ate, with the exception of three days. In that case, that will would be a will made to the women mourners, which is also invalid. He attributed the second view to the will made to others. (……)

I ZAH

"The will is invalid" As it is stated in Jami'u'l-Fatava, the correct answer is that this will is invalid. "It is permissible for those who stay for a long time and those who come from long distances."

In this matter, the rich and the poor are the same. Haniye, The long distance means that they cannot spend the night in their homes. Zahiriye, That is, if they want to return home on the same day, they do not have the opportunity to spend the night in their homes.

"It is compensated..." What is clear is that this is the case when the testator did not determine a certain amount.

«The author has adopted the first view…» In other words, the will in the text is invalid.

«With the condition of three days…» The expression of the Musannif and the expression he mentioned from Abu Bakr al-Balhi is recorded with «three days». On the third day, the women mourners gather. Then, the bequest to give them food is made to them, which is also invalid. What seems to be their custom is like this. Musannif seems to have taken this from the following expression in Haniya, which is narrated from Abu'l-Qasim: «It is not disliked to take food to those who have been afflicted with calamity at the beginning, because they are busy with the dressing of the dead and similar things. But it is not recommended to take food to them on the third day, because the women mourners gather on the third day. Then, giving them food is helping the mess.»

I say that: Salhani justified the invalidity of the will of giving food as follows: It is a will made to people. People cannot be counted. This is similar to the invalidity of the will when he says, "I made a will to the Muslims". Because there is nothing in the wording of the will in this way that indicates a need. In that case, this will is assigned to an unknown person, which is not valid.

"The second opinion is also...," which is the opinion that rules on the permissibility of the will.

I say: We have stated above that only the first opinion is valid. Its apparent meaning is that the will is absolutely invalid.

The statement at the end of the funeral section of Fethu'l-Qadir also confirms this. For it is said there: "It is disliked for the relatives of the dead to give a feast. Because feasting is permissible in happy times, not in bad times. Therefore, such a feast is an ugly bid'ah. Imam Ahmad narrates that Jarir bin Abdullah said: We used to consider gathering with the relatives of the dead and their cooking as lamentation."

It is recommended for the neighbors and distant relatives of the deceased to prepare enough food for his relatives to keep them full for a day and a night. Because the Prophet (pbuh) said, "Prepare food for Ja'far's family because a calamity has come that has kept them busy." Tirmidhi accepted this hadith as hasan, and Hakim accepted it as authentic. (……..) (Ibn Abidin, Chapter of Wills)

“Taking bread, halva, nuts, sugar and similar edible things to the cemetery together with the funeral or before or after, and distributing them at the graveside after the burial, or having food prepared on the day of the funeral or on the third, seventh or fortieth day or on other specific days, and giving a feast to the public, or bringing it to the cemetery at specific seasons and distributing it there, or taking sacrificial animals such as cattle or sheep and slaughtering animals at the graveside and distributing them are all ugly, evil bid’ahs and detestable deeds that have remained from the customs of the pre-Islamic period of ignorance. By doing such things, one does not earn rewards but sins.

Similarly, it is disliked to invite people to a meal in order to have them recite the whole Quran, recite the Surahs An'am or Ikhlas, or to have them glorify and praise each other.

Tashbih: It is known. Tahlil: It is the mentioning of the words “La ilahe illallah”. Tawhid is also this.

—Imams of hadith Ahmad ibn Hanbal and Ibn Majah narrated from Jarir ibn Abdullah (may Allah be pleased with him) that Jarir said: "We used to gather around the meal prepared by the owner of the dead person in order to count the good qualities and good deeds of the deceased and weep, and we would eat there and weep and sing at the top of our voices. When Islam was established with honor, it forbade this too, along with all our wrong actions and ugly customs."

In other words, it means, “One of our ugly customs before Islam was to gather around the meal prepared by the deceased and to praise the deceased by flattering and flattering him in order to eat a meal. Thank God, Islam has saved us from this by prohibiting this.”

Similarly, one of the customs of the era of ignorance was to bring a camel and slaughter it at the grave of the deceased and say, "This person used to feed camel slaughters to his guests when he was alive, now he will be with them after his death." Islam has also forbidden this.

—Therefore, offering sacrifices to graves, tombs of grandfathers and tombs and taking them to be sacrificed there, which still continues in some places in our time, is an ugly custom of ignorance and polytheism that has remained from the age of ignorance and lives on with the ignorance of the people.

The Messenger of Allah (PBUH) said in a hadith: "There is no slaughtering a camel at the grave in Islam." (1) This hadith saves Muslims from this ugly innovation called "grave sacrifice", which is a remnant of the age of ignorance. There is no doubt that doing something that the Prophet (PBUH) has forbidden is a detestable and ugly innovation.

Again, Ahmed bin Hanbal and Abu Dawud narrated the hadith from Asim bin Kulayb, who narrated it from his father, and whose father narrated it from someone from the Ansar, as narrated in an authentic hadith:

"A woman whose husband had died called the Messenger of Allah (PBUH) and his congregation, who were returning from the cemetery after burying her husband, and offered them food to eat. The Messenger of Allah (PBUH) and the congregation ate from the woman's food."

—Some scholars, by making an argument from this hadith, have agreed that it is permissible to have food prepared for the dead, but our scholarly jurists have also narrated this hadith and stated that it is a fact due to the possibility of a special reason and cannot be a religious ruling that is general, and the main evidence is the hadith narrated by Jarir, which all Islamic sects accept and deem worthy of being evidence. Especially if there are orphans or absent persons in the inheritance, the haram of spending the property and food of the orphan or absent persons unjustly and unnecessarily, without paying attention to other evils, is enough to be a grave sin.

There is no doubt that if unnecessary wasteful acts such as lighting candles and lamps during a meal, playing the tambourine, singing hymns and ghazals with a beautiful voice, gathering women and young people together, paying and taking money for dhikr and reading the Quran, and similar innovations and sins that are seen in our time, are committed, then these are definitely forbidden and if a will is made for these, then the will is invalid.

—In short, it is bid’ah and disliked to prepare a meal and give a feast, regardless of the day of the death, to have the Qur’an read for the soul of the deceased or to have one of the things narrated here done. However, feeding the poor, hungry and needy people you see for the soul of the deceased is a good charity, regardless of the day or even the year of the deceased’s death. Because on the day of death, that is, before a night has passed since the deceased’s death, it is sunnah for the deceased’s heir or guardian to give as much as possible as alms for the soul of the deceased. If he cannot find anything to give as alms, he should pray two rakats and give the reward for his soul. It is recommended to give as alms for the soul of the deceased every day until the seventh day, as much as is possible and easy for him. (2)

In short, giving alms for the soul of the dead, reading the Quran, performing any act of worship and donating its reward to the soul of the dead are legitimate and good virtues in the religion of Islam. However, alms is money, goods or food given to meet the needs of the needy or at least to help them. Carrying out customs that have been inherited from non-Muslims and are forbidden in the religion of Islam and spending money on such forbidden things is not alms, but a forbidden waste.

—If reading the Quran and performing dhikr, tasbih and worshipping are done solely for the sake of Allah, they earn rewards and that reward is donated to the soul of the dead. If they are not for the sake of Allah but to get money, they earn sins instead of rewards. What will they donate to the soul of the dead? Committing sins and donating to the soul of the dead does not benefit the dead. It increases the harm of the dead and disturbs them more.

The rulings quoted so far are the translation and summary of the statements in our books of fiqh. It is possible and permissible to rule on innovations and customs that have been created in our time and are not mentioned in the books of fiqh by comparing them with them.

For example, it is clearly stated in our books of Islamic jurisprudence that it is haram to give or receive money to sing taghanni, that is, hymns and ghazals with a beautiful voice, to make dhikr and to recite the Quran, and to gather young men and women together to perform ihtifal for the dead.

-Therefore, there is no doubt that the bid'ahs that have become a form of entertainment and entertainment, such as finding singers with beautiful voices to recite the mawlud for the dead, especially in the majority of mawluds in our time, which have nothing to do with the mawlud, such as hymns, poems, ghazals, so-called supplications, and women chanting various mu'alayhis to make the old people cry and the young people admire them, are tahrimi makruh (abominable) compared to singing ghazals with beautiful voices, which the jurists have declared to be impermissible. Especially, if the readers are not given money, they will not read, and if the money is not enough, they will fight, or if they do not come after bargaining before reading, they will not read, and if they do, they will not read, since there is nothing in the name of sincerity and Allah's pleasure has never even entered their minds and dreams, believing that even the dead will benefit from such meetings and mawluds, and from spending money on such bid'ah and makruh things is a false belief that is contrary to the belief of the Ahl as-Sunnah of Islam. There is no doubt that such bid'ah ceremonies, which are mostly performed for show, are makruh, it is doubtful that they are forbidden. It is not necessary and obligatory to perform such bid'ah and makruh ceremonies, but to abandon and forbid them.

— Again, it is obvious that the superstitions that are invented as the fifty-second night ceremony and prayers of the dead, which are traps for attracting money, are ugly innovations and evil lies. The book "The Will" in which these superstitions are written is clearly declared to be wrong and unfounded by the work "Criticism of the Will" published by the Presidency of Religious Affairs. Despite this, I was criticized and attacked by the Mawlid imams because I mentioned this subject in an article I wrote here last year and said "The story of the fifty-second night is a false superstition." (3)

“Islam does not need any additions. Because Islam is a complete Sharia. Allah Almighty clearly stated in the 3rd verse of the Maidah Surah that He completed and perfected it: “Today I have perfected your religion, completed My favor upon you, and chosen ISLAM as a religion for you.” Trying to add something to what is complete and perfect means doubting its perfection or wanting to corrupt it. In this respect, Bid’ah is abhorrent and bad. Following Bid’ah and spreading Bid’ah is even worse and is doing harm to Islam.”

“As it is known, Bid'ah is something that is not included in the sources of Islam such as the Book, Sunnah, Ijmaa, Qiyas, but is later invented, believed in and done by considering it as Islamic.” In fact, those who commit Bid'ah do so thinking that they are worshipping and therefore earning reward. However, they do not even know that they are actually earning sin instead of reward. There are many false beliefs, Bid'ahs and Superstitions that have settled among Muslims. First of all, I would like to focus on only two of the BID'AHs committed for the purpose of worship.

But first, what is BID'AT? Let's focus on its definition. Let's give the definition of Ibn Abidin (may Allah have mercy on him), one of the most beautiful and famous definitions, one of the well-known scholars of the Islamic world. It is defined in Durr al-Mukhtar as: "—-Bid'at is to believe contrary to what is known and known from the Prophet (peace and blessings of Allah be upon him)." (4)

So, what is the starting point of this definition? Let's take a look at it now. Isn't it our Master, our Sultan, Hz. Muhammad (peace be upon him), the messenger of the two worlds, who was sent as a mercy to the worlds, who forbade and prohibited bid'ah? Yes, it is him!

In one of his hadiths, he said: “There are only two things to follow. The best of words is the word of Allah, and the best of ways is the way of Muhammad (peace be upon him). Be careful to avoid things that have been invented in religion. For the worst of things are those that have been invented. Every invented thing is Bid’ah, and every Bid’ah is deviation.” (5)

In another hadith: “Allah, the Almighty and Majestic, does not accept anything from the person of Bid'ah, from prayer, fasting, charity, Hajj, Umrah, Jihad, obligatory or voluntary acts. He leaves Islam like hair leaves dough.” (6)

In another hadith, it is stated: “Be extremely careful and alert against the things that come out later. Because every new thing that comes out is a BID'AH. Every Bid'ah is a deviation and misguidance.” (7)

In another hadith, the Messenger of Allah (peace and blessings of Allah be upon him) said: “Anyone who fabricates something that is not in our religion will have his invention rejected. Every Bid'ah is misguidance.” (8)

In another hadith, it is stated: “If a people (society) introduces a Bid'ah, its equivalent is eliminated from the Sunnah.” (9)

Imam-i Azam Abu Hanifa (may Allah have mercy on him) said that one should not pray behind the person of Bid'ah. Imam-i Ghazali said: "Rejecting Bid'ah and avoiding it is an approved Sunnah. Every Bid'ah is disparaged and is a deviation." (10)

Now let's come to this work that is considered Bid'ah.

To prepare and distribute food and halva in the name of the deceased on the day, night, third night, seventh night, fortieth night, fifty-second night or days after the deceased's death.

     1) It is stated in a hadith numbered 6497 under the title of “Gathering at the Funeral Home” as follows: “Cerir Ibn Abdillah al-Baceli (may Allah be pleased with him) narrates: “We (during the time of the Messenger of Allah) considered gathering at the house of the deceased and (the people of the house) cooking for the deceased as part of the forbidden mourning.” (11)

2)__"The sunnah for the guardian of the deceased is to give charity to the poor before the first night after the burial. If he cannot find anything to give charity, he should pray two rakats and give the reward to the soul of the deceased. It is recommended to give charity and donations that will make the soul of the deceased happy every day until the week. It is disliked for the guardian of the deceased to make meals and prepare halva and feast. Because feasting is reserved for joyful times. It is an ugly BID'AH at such sorrowful times. It is recommended for the neighbors and relatives of the deceased, even if they are far away, to prepare a meal that day and night, take it to the relatives of the deceased and eat it together." (12)

3)__"One of the disliked Bid'ahs committed today is the slaughtering of animals when the deceased leaves his house or at the grave and preparing food for those who have gathered to offer condolences and offering it to them. Indeed, this is done on joyful days and in halls of joy. When there are those among the heirs who are younger than puberty, it is forbidden to prepare food and offer it to them... When it is said that the neighbors and friends should prepare food for the deceased's family and send it to them, this is recommended. Because the Prophet (sallallahu alayhi wa sallam) said: "Prepare a meal for the family of Ja'far, so that something has come to occupy them." It is indicated to them in the meal. Because sometimes grief prevents them from eating." (13)

4)__"It is recommended for the neighbors and relatives living nearby to send food for a day and night to the house where the funeral takes place. When Ja'far-i Tayyar (may Allah be pleased with him) was martyred by more than seventy sword and arrow wounds, the Messenger of Allah (peace and blessings of Allah be upon him) ordered that food be sent to his house. Eating from the house of the dead, distributing halva is a detestable and ugly BID'AH. It is detestable to make halva and buns on the first, third, seventh, [fortieth and fifty-third] days, to distribute food at the graveside, and to gather the hafiz, clerics, and mevlid singers, to have them read and to give them food.

Most of these are done for show and fame. While these Bid'ahs are being done, many haram things are mixed in. It is also invalid to make a request for them to be done. It is unlistenable and sinful.” (14)

5)__"It is stated that the period for neighbors and relatives to prepare food for the family of the deceased is one day and one night. Aliyyü'l-Kari says: "Because sadness generally keeps a person busy for a day to the extent of keeping him from eating." After stating that it is recommended to prepare food for close neighbors and distant relatives, Ibn'l-Humam states that it is disliked for the funeral home to give a feast to the visitors. "Because the feast is legislated for joy. Not for calamities. This is a very ugly INVENTION." (15)

6)__"The week of the dead, the fortieth and fifty-second night: Such things are Bid'ah behaviors that do not exist in Islam and were not practiced during the living periods of Islam. Bid'ahs like this always appear with the weakening of religious life and beliefs... Like distributing halva on the 40th and 52nd night of the dead, etc." (16)

7)__"It is BID'AH for a deceased person to make a will that food be given to him on the day or night of his death or that something like halva etc. be distributed. It is BID'AH to make a will that food be given to him on the third, seventh, fortieth or fifty-second night of his death or on the anniversary of his death.

However, it is recommended for the neighbors to bring food to the family of the deceased. The founder of the Hanbali School, Imam A.B. Hanbal (may Allah have mercy on him), said: “He considered it as a custom of the pre-Islamic period to feed the deceased before he is buried, or on the day or night of his death, or on the third or seventh day.” Mayyid said, “It is a BID’AT to make a will that food be fed and a Mawlid be recited on the day or night of his death, on the third, seventh, fortieth, or fifty-second day, or on the anniversary of his death.” (17)

8)__"When Hazrat Ja'far (may Allah be pleased with him) was martyred, the Messenger of Allah (peace and blessings of Allah be upon him) said to his relatives: "Prepare food for the Ja'far family, because a great disaster has befallen them, so that they will not be able to eat or drink." It is recommended for relatives and neighbors to prepare a day's food for the family who has suffered the tragedy of death and take it to them. However, it is considered makruh by Islamic scholars for the family of the deceased to prepare food and offer it to others, since it is both a custom of the pre-Islamic period and a timeless burden, and some have said that it is haram." (18)

9)__"It is not permissible to cry loudly after the death... There is no harm in the neighbors cooking for the deceased. It is the same in Tebyin. In the first three days following the death, it is not permissible for the family of the deceased to feed or give a feast. It is the same in Tatarhaniyye." (19)

10)__"It is recommended for the relatives and neighbors of the deceased to prepare food and take it to the house of the deceased… …It is MAKRûH, BID'AH, and has no basis. Because by doing so, the distress and grief of the family of the deceased will be increased. Their busyness will be added to their preoccupations and they will resemble the customs of the Age of Ignorance. Especially if there are children who have not yet reached puberty among the heirs of the deceased, it is forbidden to prepare food in such a house and offer it to guests and visitors." (20)

11)__"The guardian of the deceased should donate the reward to the deceased by giving whatever he can to the poor from the first day to the seventh day after the burial. This is a sunnah. If he cannot do this, he should pray two rakats and donate the reward. However, it is MAKRûH for the owners of the deceased to give a feast on the first, third day or a week later. However, it is recommended for the neighbors or distant relatives of the deceased to prepare food and treat the deceased to it and to insist (force) them to eat." (21)

12)__"There is no harm in giving food to the family of the deceased. It is stated in the Feth. It is recommended that the neighbors and distant relatives of the deceased cook food for them and feed them that day and night. Because the Prophet (peace and blessings of Allah be upon him) said: "Cook food for the family of Ja'far, because a calamity has befallen them that will keep them busy." Tirmidhi found this hadith hasan, and Hakim authenticated it. Also, this act is a good deed and a blessing. The one who brings food should insist on feeding them.

Because grief and sorrow prevent them from eating; for this reason, they are weak. The owner of the conquest also said the following: “It is disliked for the owner of the funeral to give a feast… This is an evil BID’AH.” …..There are also the following lines in Bezzaziye: “It is disliked to cook on the first and third days and after a week, to take food to the grave on the feasts, to invite to recite the Quran, to gather the pious and the hafiz to read the hatim or the Sura-i Enam or the Ikhlas.” The owner of the Miraj spoke about this issue at length and said the following: “All of these acts are hypocrisy and ostentation. They should be protected from them. Because those who do these do not seek the pleasure of Allah.” (22)

13)__"Feast at the funeral home: In some villages, food preparations begin that day in the house where the funeral takes place. The congregation present for the service of washing and burying the deceased participate in this feast and eat the prepared food. This action is a makruh close to haram. It is considered makruh to organize a feast at the funeral home for a week…….

Fifty-second day custom: In many places, the fifty-second day of a deceased person is counted, when that day comes, a Mawlid is recited and a fifty-second prayer is read. In our religion, the benefits of reading the Quran, praying and giving alms for a deceased believer cannot be denied. However, there is no meaning or basis for counting and calculating the seventh, fortieth and fifty-second days. Those who are alive should fulfill their Islamic duties towards a deceased believer and should not ignore the principles of our religion while fulfilling these duties……

Is it religiously permissible to recite Mawlid and Quran counting the days after the death?

Answer: There is no rule or recommendation in our religion to count the 7th, 40th or 52nd days after the death of a person. Some of the treatises that state these have no scientific or religious basis.” (23)

14)__ “It is disliked and bid’ah to give a feast for the dead on the 1st, 3rd, 7th, 40th day and 52nd night, on the first, third, seventh, forty and fifty-second night of the year, during the recitation of the Quran, for supplication, for the recitation of the Surah An’am or the Surah Ikhlas, or to cook for fame or ostentation, and all of these should be done in graves, on religious holidays and in mosques, and for women to be invited to eat the mentioned meal in the house of a person who is not a mahram and for them to go to that meal.”

“In some places, the fortieth and fifty-second nights of a person who dies are calculated and a Mawlid is recited on that night.
In Islam, the Quran read for a deceased believer, the prayers made and the alms given are beneficial. However, the seventh, fortieth and fifty-second nights have no meaning or Islamic source. The Quran to be read can be read every day and every night. This is one of the bid'ahs introduced into Islam. There is no benefit in practicing bid'ah. "It is makruh to organize a feast and feed the deceased for three days in his house.
It is a sunnah for relatives and friends to bring food to the family of the deceased for three days. Unfortunately, in many parts of our country, this sunnah has been replaced by heresy. Food is prepared for those who come to offer their condolences, and it has become almost like a wedding.”
(24)

15)__ ” ‘Meal Preparation in the House of the Dead’

It is a sunnah for the relatives and friends of the deceased to take food to the family of the deceased for three days. Unfortunately, in many towns and villages of our country, the opposite path has been taken by replacing this sunnah with BID. The family of the deceased prepares food for those who come to offer their condolences and creates the atmosphere of a wedding or circumcision gathering. Especially the clergy and the mevlidhans should be very careful about this issue and warn the Muslims.” (25)

16)__ ” Under the title of 'Condolence', it was written "Innovations and Superstitions Related to the Subject" and it was stated as follows: "Offering food, candy and chocolate to those who come to offer condolence for twenty days." (26)
17)__ “A CEREMONY IS HELD AND ALMS ARE GIVEN ON THE FORTIETY OR FIFTY-SECOND NIGHT OF THE DEATH. DOES THIS HAVE A PLACE IN ISLAM?
"Nothing has been reported about the fortieth and fifty-second nights of the dead. It is not right to organize special ceremonies for such nights. It is a bid'ah invented by ignorant people. It is always good to pray for the dead and give alms. It is not allocated to this or that night." (Şamil İslam Ansiklopedisi, Ölüm Makalesi)

18)__

The Seventh, Fortieth, and Fifty-Second Night of the Dead

"These kinds of things are heretical behaviors that do not exist in Islam and were not practiced during the times when Islam was practiced. Heretical behaviors like these always appear with the weakening of religious life and beliefs, and they serve to prove two things:

1. This means that people cannot live without faith. If they do not learn and follow the true religion sent by Allah, they will practice the nonsensical, false religions they have invented.

2. People who live the religion of Islam consciously do not need such innovations.

However, it is also true that some actions will benefit the dead and the reward of some behaviors will reach them. Most scholars have said, for example, that alms given for a deceased person, charities done, the Quran read in accordance with its conditions, and prayers made will reach them.
